La empresa cuestiona la sentencia y sostiene que existen recursos pendientes y una omisi\u00f3n de consulta prejudicial al Tribunal de Justicia de la Comunidad Andina.La compa\u00f1\u00eda vincula el caso con la expropiaci\u00f3n en 2010 de sus acciones en FANCESA, por la que reclama al Estado una indemnizaci\u00f3n cercana a los 300 millones de d\u00f3lares que, seg\u00fan afirma, lleva 16 a\u00f1os sin resolverse. Para SOBOCE, la exigencia de pago inmediato contrasta con la demora en su reclamo contra el Estado.Ante ello, llev\u00f3 su denuncia ante la Comunidad Andina por presunto trato discriminatorio, no por la indemnizaci\u00f3n, y solicit\u00f3 suspender la ejecuci\u00f3n del cobro mientras el tribunal andino examina el caso.
