Legisladores del Partido Dem\u00f3crata Cristiano (PDC) propusieron una designaci\u00f3n por decreto supremo de forma transitoria, mientras que desde la oposici\u00f3n rechazan esa v\u00eda por considerarla inconstitucional.El diputado Alejandro Medinaceli (PDC) afirm\u00f3 que no reconocen a Luis Monta\u00f1o como fiscal general interino por su posible vinculaci\u00f3n con Mariaca y plante\u00f3 que un decreto permita nombrar a una nueva autoridad hasta que la Asamblea elija al titular. En la misma l\u00ednea, la diputada Claudia Bilbao se\u00f1al\u00f3 que Monta\u00f1o, al haber sido designado por el exfiscal, no goza de confianza y podr\u00eda poner en riesgo las investigaciones.Por su parte, los diputados Edgar Zegarra y Lissa Claros rechazaron la figura del decreto. Sostuvieron que la Constituci\u00f3n establece que la designaci\u00f3n del Fiscal General corresponde exclusivamente a la Asamblea y que Monta\u00f1o asumi\u00f3 por prelaci\u00f3n conforme a la institucionalidad del Ministerio P\u00fablico.
