La decisi\u00f3n se da en atenci\u00f3n a la imputaci\u00f3n formal de la Fiscal\u00eda, que solicit\u00f3 su reclusi\u00f3n en el penal de Palmasola por los delitos de conducta antiecon\u00f3mica e incumplimiento de deberes.Durante la audiencia, el alcalde Fern\u00e1ndez cuestion\u00f3 que sea procesado con un informe \u00aboperativo\u00bb de la Contralor\u00eda General del Estado y atribuy\u00f3 el caso a un \u00abhecho pol\u00edtico\u00bb. La defensa anunci\u00f3 que apelar\u00e1 la determinaci\u00f3n.
