La Sala argument\u00f3 que no corresponde contrastar una norma de car\u00e1cter general con la Constituci\u00f3n Pol\u00edtica del Estado (CPE) para establecer su incompatibilidad.V\u00e1squez hab\u00eda argumentado que el decreto vulnera la CPE y que las decisiones adoptadas bajo esa modalidad har\u00edan nulos los actos del mandatario. Sin embargo, la justicia no ingres\u00f3 al fondo de la problem\u00e1tica planteada y rechaz\u00f3 la demanda.
